Book and album covers may be different. But I've never heard of anyone getting sued for using a book cover copied off a publishers' promotional site for a book.

In a weird way, I can see how taking your own photo could get you into more trouble than using one supplied by an artist or label on its own site, because your own photo might no be as good and reflect worse on the person who created it than the "official" publicity photo.
